These terms set out the rules for using the Diurna website and services. Please read them carefully before you use the service.

Acceptance of these terms

These Terms of Service (the Terms) govern your access to and use of the Diurna website at www.diurna.ch and the related services operated by Soulcode AG (Diurna, we, us). By accessing the site or using the service, you agree to these Terms. If you do not agree, do not use the service.

The service

Diurna is a platform for automated and semi-automated content production. It turns research, drafting, review and publishing into configurable pipelines that run on a cadence, pausing for human review where you decide.

We may add, change or remove features at any time. We aim to keep the service available and reliable, but we provide it on an as-is basis and do not guarantee uninterrupted operation.

Accounts and registration

Some parts of the service require an account. You are responsible for the information you provide, for keeping your credentials secure, and for all activity under your account. Notify us promptly of any unauthorised use.

Acceptable use

You agree not to misuse the service. In particular, you must not:

  • break any applicable law or infringe the rights of others;
  • upload content you have no right to use, or that is unlawful, harmful or misleading;
  • attempt to disrupt, reverse-engineer or gain unauthorised access to the service or its infrastructure;
  • use the service to generate spam, malware or content that violates a third party's rights.

Your content and intellectual property

You retain ownership of the content, personas and voice you bring to Diurna, and of the outputs the service produces for you. You grant us the limited rights needed to operate the service on your behalf — to store, process and transmit your content so the pipelines can run.

The Diurna software, brand and site remain the property of Soulcode AG. These Terms grant you no rights in them beyond use of the service.

Third-party services

Diurna relies on third-party providers — including model, hosting, database and crawling services — to deliver the service. Your use may be subject to their terms, and we are not responsible for their acts or omissions.

Disclaimer of warranties

The service and all content on this site are provided as is and as available, without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the service will be error-free, secure or uninterrupted, or that outputs will be accurate or fit for a particular purpose. You are responsible for reviewing outputs before you rely on or publish them.

Limitation of liability

To the fullest extent permitted by law, Soulcode AG is not liable for indirect, incidental or consequential damages, or for lost profits, data or goodwill, arising from your use of the service. Nothing in these Terms limits liability that cannot be limited under Swiss law.

Suspension and termination

You may stop using the service at any time. We may suspend or terminate access if you breach these Terms or if we must do so to protect the service or comply with the law. Provisions that by their nature should survive termination — including content ownership, disclaimers and limitations of liability — continue to apply.

Changes to these terms

We may update these Terms from time to time. When we do, we revise the date above and, where the change is material, we take reasonable steps to let you know. Your continued use of the service after a change means you accept the revised Terms.

Governing law and jurisdiction

These Terms are governed by the laws of Switzerland, without regard to conflict-of-law rules. The exclusive place of jurisdiction for any dispute is the registered seat of Soulcode AG, subject to any mandatory statutory venue.
